[Silkroad Online Item Mall User Agreement]
Article 1 (Objective)
This User Agreement is in regards to the product/service of the internet-based MMORPG (Massively Multiplayer Online Role Playing Game) Silkroad Online game service ("Service" hereafter) by Joymax Co., Ltd ("Company" hereafter) and, specifically, the rules and regulations which governs the Premium Service offered through the use of the Item Mall and the operations based on the Silkroad Online website (
http://www.silkroadonline.net) in the requisite acquisition of currency to be used on the Item Mall.
Article 2 (Agreement Effect and Changes)
1. This Agreement shall come into effect when the User clicks the "I Agree" button on the Item Mall User Agreement after having fully understood and agreed to the internet game service User Agreement and read the Item Mall User’s Guide on the Silkroad Online website (
www.silkroadonline.net).
2. This Agreement is subject to revision at the Company's discretion during the Service period, provided that no applicable laws are violated. All changes shall be posted as notices on the Silkroad Online website (
www.silkroadonline.net) in order to notify the Users.
3. Agreeing to this Agreement signifies that the User shall regularly visit the Silkroad Online website (
www.silkroadonline.net) in order to be informed of any changes to the Agreement and other notices. The Company shall not be responsible for any damage found to have resulted from the User’s failure to familiarize him/herself with the contents of the Agreement and posted notices.
4. The User's right to disagree with a revised Agreement notwithstanding, in the event that the User does not agree to the revised Agreement, he/she may have his/her access to the Service suspended or terminated. However, if the User does not submit the “I do not agree” declaration of intent within 7 days of the effective start of the revised User Agreement, the User shall be deemed to have agreed to the revised User Agreement.
Article 3 (Agreement Regulations)
All situations not clearly covered by this Agreement shall be subject to the applicable laws and regulations
Article 4 (Terms and Definitions)
1. “Item Mall Service” ("Item Mall" hereafter) refers to the premium service operating through the Silkroad Online website (
www.silkroadonline.net) and the game client.
2. “Premium Service” refers to the acts and operations related to the purchasing, through the Silkroad Online website, of currency needed to utilize the Silkroad Online Item Mall.
3. “Free Service” and “Standard Service” refer to all Silkroad Online services that are not Premium Services.
4. ‘Silk’ is divided into regular Silk (“Silk” hereafter) and Premium Silk.
5. ‘Silk’ refers to the internet/cyber currency used to purchase and use premium contents, through the Silkroad Online Item Mall. Premium Silk item cannot be purchased with Silk
6. ‘Premium Silk’ refers to the internet/cyber currency used to purchase and use premium contents, through the Silkroad Online Item Mall. Premium Silk Item and Silk Item can be purchased with Premium Silk
7. 'Premium Silk Gift' refers to the act by which one User gives to another User the Premium Silk purchased through the Item Mall.
8. “Item Mall” refers to the virtual space in which the Silk purchased on the web can be used to purchase Premium Items on the Silkroad Online Item Mall.
9. “Premium Item” refers to the items purchased through the Item Mall using Silk or Premium Silk through the Silkroad Online Item Mall
10. “Premium Item” is divided into Silk Item and Premium Silk Item
11. “Silk Item” refers to the items purchased through the Item Mall using Silk or Premium silk on the Silkroad Online Item Mall
12. “Premium silk Item” refers to the items purchased through the Item Mall using Premium Silk on the Silkroad Online Item Mall
13. ‘Payment Option’ refers to the tools by which the User pays service fees to the Company in order to purchase Silk or Premium Silk, through tools developed by the Company itself or contracted payment services.
Article 5 (Payment Options)
1. In making a payment to charge Silk or Premium Silk on the Silkroad Online website (
www.silkroadonline.net), the User must read the User Guide and other help-related notices before making the payment. The company shall not be responsible for any loss to those who neglect to review the User Guide and other help-based documents.
2. Because the types and the method of use of Payment Options are subject to change, notification of all changes will be communicated through the homepage
3. The Service may be momentarily suspended depending on the service status of some payment option, and on the circumstances of partner payment option companies of the Company.
Article 6 (Silk User Guide)
1. Silk and Premium Silk shall only be charged by Silkroad Online members.
2. As the fees for charging Silk or Premium Silk are subject to occasional change dependent upon the Company’s policies, information relevant to the charging of the Silk or Premium Silk shall be made available on the Silkroad Online website.
3. The company may, if necessary, place time/rate/quantity limits on Silk or Premium Silk charging, other than this dependent on the special characteristics of the payment option used a limit may be imposed there as well.
4. Silk and Premium Silk shall only be used to purchase Premium Items on the Item Mall.
Article 7 (Silk Charge Payment Approval)
1. The Company may suspend approval or reject the transaction for the following reasons:
1) The User is not a Silkroad Online member.
2) The Service fee is not paid or the payment cannot be verfied.
3) The User has been found not to possess adequate mental faculties.
2. In the following cases, the Company may not approve the registration request until the issues have been ameliorated:
1) It has been decided that the normal Service cannot be offered due to the limited server space.
2) The Service is impeded.
Article 8 (Use of Item Mall)
1. The Item Mall can be used within the Silkroad Online client and on the homepage. The Item Mall User Guide and other Item Mall information shall be availble, and purchases made, on the Silkroad Online website.
2. Only Silk and Premium Silk shall be used to purchase Premium Items on the Item Mall.
3. Types of items, purchased using Silk or Premium Silk on the Item Mall, are subject to change dependent upon Company policies. They may also be changed periodically due to functional improvements and patches.
Article 9 (Silk and Premium Silk Use Restrictions, Effective Period)
1. In reference to the Silkroad User Agreement, the use of the Service may be restricted.
2. In the event of a Service restriction through the reference to the User Agreement, there shall be no Silk or Premium Silk compensation, purchase cancellation and refund, Service restart, or the reuse of the Silk or Premium Silk.
3. Charged Silk or Premium Silk shall have an effective period of one (1) year and, in the event that there is no Silk or Premium Silk has been added or used within one (1) year, the remaining Silk and Premium Silk shall expire.
4. Items purchased with Silk cannot be traded with other members
5. Items purchased with Premium Silk can be traded with other members. However, some items cannot be traded even though they were purchased with Premium Silk. In the event that the member does not carefully read the item description and purchases an item in error, the Company shall not be held responsible.
6. The Premium Silk in possession can be given to other members as a gift. The Company shall provide the service in such a way that the member may verify the history of the Silk usage.
7. The Company shall not be responsible for any situation which arises from inaccurate execution of gifting Premium Silk. (That is, situations which occur due to the member's error such as erroneously entering the name of the recipient character.)
Article 10 (Refund Policy)
1. All Fees and charges are non-refundable.
2. You understand that the Company may permanently terminate your Account if a charge which you authorize the Company to make on your payment cannot be processed or is returned to the Company unpaid for any reason whatsoever. The Company shall not be held responsible or liable for any credit card or bank-related charges or fees related to any of your transactions.
This Agreement is effective as of 11/09, 2010.
